Nigeria rights groups find 86 lawyers for man with 86 wives

A coalition of Nigerian human rights groups has mobilized 86 lawyers to defend the country's most married man, currently detained for unlawful marriages and inciting contempt of Islamic religious laws, an activist said today.

I never blame the man for marrying up to 86 wives, and if my
candid opinion is to be sought, i will suggest he be allowed to.
The whole 100% blame is shifting to the whole Muslim Umma
and the Niger Muslims in particular for allowing the man retain
the wives up to this time.  Only God knows what exposes him
as he has been living a better life among his people before now.

Does it mean that the guys has been living alone all his life?
Its too late to call him to order.  Let this crop of lawyers
carry on with their work, and going by the system, I am sure
they are going to succeed, they will only allow the lower
court to mumble before you know it they will appeal its
decision - a nan ne matar zata kada mijin.

Human rights indeed? which kind of right? if the guy was in the west, he'd be given 85 life sentences (one for each  wife) for exponential polygamy! Su dai lawyoyin nan in a kace musulunci, shikenan, sun sami nayin adawa!

What the courts should do since yaki sakin matan nasa, is to divorce them from him by force and leave the first four wives only, since they are the ones legally married to him.

women from their parents places, he paid their dowries
and the wives are sane and have agreed and his i
in-laws also agreed on the conditions - these and
other evidences will play a vital role in an upper court.

Dan Borno, there is no legality to it. The legality ended with the fourth wife. The moment ya ce zai auro wata after the fourth wife, whether the parents are aware of her being about to be the fifth or they are kept in ignorance, the whole thing becomes condemnable.  In the sight of God, the marriages after the fourth wife are null and void and they are only living in what the Yorubas term as  'Wa Joko'
What in effect you are saying is that the other side of the coin is also legal that is a man who divorces his wife three times can still continue to call her his wife and live with her as such.
We shouldnt look at what the courts may say or the evidences that they will rely upon when passing judgement. We should look at what is written down in the Sharia pertaining to marriage and the number of wives permitted for one man at any one moment. After all however the judges look at the matter, the prime consideration at the back of their minds will be that this man is a muslim and as such must obey the tenets of Islam, as laid down by the Sharia. If he were other than a muslim, then he might be allowed to live with all of his wives since he would be following the dictates of his nafs.
One thing you have to look at DB is that the women are not being treated fairly by being married to one man. There are too many of them and this is apt to lead to neglect and negligence and in any case from the interviews conducted with the man, it seems he doesnt support any of them financially.

The detained super polygamist Alhaji Bello Abubakar Masaba's  86 wives yesterday staged a noisy protest at the premises Niger State Ministry of Justice and demanded for the immediate release of their embattled husband. Masaba, who has been detained at the Minna Prison since Monday, is standing trial before the Upper Sharia Court, Minna for marrying 86 wives, contrary to the Islamic injunction that limits a man to not more than four.

The women, accompanied by at least 20 of Masaba's children, raised placards and chanted slogans in solidarity with their husband, who they said committed no crime.

Some of the placards read, "Our husband is innocent, he is God-sent", "What Allah has joined together, let no man put asunder", "We are legally married to Baba and we are not complaining."

Spokesperson of the Masaba wives Hajiya Hafsat Bello Masaba, who said she was wife number three, said she has been married to Alhaji Bello for over 20 years with four children, adding that the allegations against Masaba were a ploy to bring hardship to a law abiding citizen of Nigeria.

"The judgment at the sharia court is an abuse of justice and the rule of law. If we are not complaining, and our parents are not complaining, what is the sharia commission or the Etsu Nupe to complain for us?"

She added, "We are happy living together. Some of the men persecuting Baba today have only two wives, yet their homes are not stable. Baba has 86 wives and has been able to sustain a peaceful home. They are simply jealous of his achievements. They should thank Allah that somebody like Baba lives in their midst. If not somebody sent by God, do they think it is easy keeping 86 women in one house without fight? Baba does not believe in adultery like many of those fighting him. You can see we are not hungry, Baba is really taking good care of us, what is Etsu Nupe's concern in the matter?" Hajiya Hafsat said.

No official of the ministry attended to the protesting women. The state Acting Solicitor-General and Permanent Secretary, Barrister Ndagi Usman Wali said it would be prejudicial for him to comment or make statement on a matter already in court. The women, led by one of the sons, Maroof, arrived the ministry in three different vehicles.

Meanwhile, the embattled Alhaji Bello Abubakar Masaba yesterday asked an Abuja Federal High Court to declare that the Sharia Court has no jurisdiction to try him for marrying 86 wives.

Masaba, 84, moved his case to Abuja yesterday by dragging the Jama'atu Nasir Islam (JNI) and Bida Emirate Counsel before the court for their role in what he called "alleged attempt to breach his fundamental human rights."

The applicant is seeking an order of the court to restrain the respondents or any person or group of persons from undermining his rights to marry as many wives as he likes. Marrying more than four wives, according to JNI, is a violation of Islamic laws. The applicant was arrested on September 8 and charged before a Sharia Court sitting in Minna, the Niger State capital for acting contrary to Islamic doctrine. He was subsequently remanded in prison custody.

But Masaba said his arrest and arraignment before an Islamic Court was a violation of his fundamental human rights which the Abuja Federal High Court had a couple of weeks ago granted him leave to enforce.

He prayed the court in a motion filed by his counsel, Mr Femi David Ikotun, to declare that the 1999 constitution of the Federal Republic of Nigeria is supreme and has a binding force on all authorities and persons throughout the country.

He wanted the court to declare that "the issuance of 'Fatwa' by the JNI, which is an order any Muslim in Nigeria who finds him (Masaba) should kill him for marrying 86 wives is a contravention of his right to life and personal liberty as enshrined in the constitution of Federal Republic of Nigeria, and it is therefore null and void and of no effect."

The case was not mentioned because the judge to whom it was assigned could not sit. But Masaba's counsel told Daily Trust that they were expecting that the case would be mentioned on Monday. However, the respondents in a notice of preliminary objection filed by their counsel, Mr Yahaya Mahmood, argued that the court has no competence or jurisdiction to hear the case.

Mahmood said there is nothing in the processes filed before the court to show that the respondents did more than advise Masaba against his actions.

"The JNI, an umbrella Islamic organisation, cannot be restrained from giving an advice on the position of Islamic Law on any matter within its jurisdiction through the process of fundamental rights enforcement," the objection read.

I never blame also the man for marrying up to 86 wives. Because that is there tradition, to marry many wives as long as he can give his wives the things that they need. That is not an issue to our law.
